Akuapem Poloo heads to Court of Appeal after 90 days sentence

Lawyers of convicted actress Rosemond Alade Brown popularly known as Akuapem Poloo have filed a notice at the Court of Appeal challenging the dismissal of her appeal by the Ghanaian High Court.

 

Recall the actress had shared a nude picture of herself alongside her son, to mark his seventh birthday on her social media handles in June 2020.

 

She was virally condemned for the post but the Director of Child Rights International, Ghana, Bright Appiah, filed a petition seeking her prosecution.

 

However, Poloo had apologised over the post, saying the picture was originally meant to encourage people to appreciate their mothers.

The matter was, however, referred to the Domestic Violence and Victims Support Unit (DOVVSU) in Ghana which led to the actress arrest.



She was later charged with publication of obscene materials, engaging in domestic violence and undermining human dignity.

 

The actress in court on Friday pleaded guilty and was consequently convicted.

 

The Circuit Court sitting in Accra, the Ghanaian capital, on Friday ruled that the actress would serve her three months jail term concurrently.

 

Her sentence is to serve as a deterrent to others in the country, the court said. She later filled an appeal.

 

The court also ordered that in the absence of the convict, Akuapem Poloo’s child should be given to any competent person in the family to take care of.

 

Jail you Go

On Monday, December 1, 2021, the High Court presided over by Justice Ruby Aryeetey dismissed her Appeal seeking a non-custodial sentence instead of a custodial sentence.

 

The High Court ruled that, the 90 days custodial sentence imposed on her by the Circuit Court was not “manifestly excessive” and “harsh” and therefore cannot interfere with that decision.

 

I am not Staying

Five days after, her lawyers led by Andrew Kudzo Vortia filed a notice of appeal to challenge that decision and notice for bail.



A copy of the notice of appeal sighted by Starrfm.com.gh filed on Monday, December 6, 2021, stated as follows;

“Please take note that the convict/appellant/appellant hearin, being aggrieved by the judgement of the High Court Criminal Division (1)Accra, Her Ladyship Ruby Aryeetey dated 1st December 2021 dismissing the appellant appeal against the conviction and sentenced to 90 days imprisonment imposed on the appellant on each count to run concurrently by Her Honour Mrs Christiana Cann dated April 16, 2021 hereby appeals to the court of appeal on the grounds set out below and for the release stated here under.

 

“That the learned judge erred in failing to appreciate that as a young first offender and a single parent, a noncustodial sentenced of a fine instead of a custodial sentence of 90days imposed on the appellant by the trial court is appropriate in this case,” the notice of appeal stated.

 

“That the custodial sentence of 90 days imposed on the appellant be set aside and in lieu, be substituted with a non-custodial sentence or a fine,” it stated.

 

Aside, the notice to appeal, the lawyers have also filed for bail pending the determination of the appeal.

 

EIB Network’s Court Correspondent Murtala Inusah reports that the notice for bail application would be moved on December 15, 2021.

The case previously attracted the attention of Rapper Cardi B.

 

“I seen a lot of Americans do photoshoots like that,” the musician tweeted in April.

 

“I don’t think she was going for sexual. More going the natural idea.”

 

The convict is currently serving the remainder of her jail terms.

 

Family Breaks Silence

Spokes person of the Poloo’s Family, Kofi Mullan confirms Akuapem Poloo is in jail.



When interviewed by  Peace Fm, he said, “If you’re being sentenced, you’ll, by all means end up in jail. The police were the ones who took her away. We as a family were devastated, so we did no know follow up on anything.

 

“We often talk to her”, he continued. “We know where she is but we cant say anything now.”

 

“She is holding up. Although it is not easy, she will pull through. All we need to do is support her,” he added.

 

Forget ungrateful Akuapem Poloo and reach out to the boy – Afia Schwarzenegger to Ghanaians

Afia Schwarzenegger has tendered in a plea to Ghanaians on behalf actress Akuapem Poloo.

 

The comedienne has begged Ghanaians to overlook Akuapem Poloo’s stupidity and ungrateful nature and help her son who will be feeling lonely this Christmas and beyond.

 

Afia Schwarzenegger said she of all people know how difficult it is not to have your mother around as a child.

 

She used her life as an example and narrated how she wept when her mother was not around on a certain festive season.

 

Afia Schwar then pleaded with Ghanaians to provide the little support they can to Akuapem Poloo’s son so he does not miss his mother much as she serves 90 days in jail.

 

No matter what has happened, you are still in my prayers and God will send you strength ….I spent Christmas without my mother and even though I was old n a mother myself I cried like a baby.

Kindly check on her son daily if you are close to them…forget about his ungrateful mother n reach out to the boy…he needs our love now than ever.

I won’t visit Akuapem Poloo in prison – AMG Armani

AMG Armani, a Ghanaian rapper who was recently photographed with Akuapem Poloo in viral social media images, has spoken out about her recent prison term.

 

“The only thing I can do is support Akuapem Poloo in prayer,” he stated on Kastle FM, “but paying her a visit in jail won’t alter anything.”

 

“I mean, we simply leave the law to those who know best,” he continued, “so all I can do is hope for God to protect her and bring her back.”
